If you have recently submitted an application, your application is pending lodgement following preliminary checks regarding the adequacy and completeness of information. Updates about your application will continue to be provided via the NSW Planning Portal, including advice around fees and confirmation lodgement when the application is accepted. Once your application has been accepted for lodgement a fee quote will be generated and sent via the NSW Planning Portal. Payment can be made either over the phone (credit/debit card with 0.78% surcharge), via mail (cheque) or in person at the Civic Centre in Moss Vale (cash, cheque, debit card or credit card with 1% surcharge). The Government Information (Public Access) Act 2009 (GIPA Act) provides that anyone may inspect, free of charge, certain documents held by a Council including (among others) Development Applications and associated documents. A Council complying with its obligation under the GIPA Act does not breach copyright law. However, a person who through this process obtains a copy of a survey or other plans subject to copyright, would be in breach of copyright law if those plans were later used in a way adverse to the interest of the holder of the copyright. If you do copy, reproduce, republish, upload to a third party, transmit or distribute in any way plans, building specifications or other documents subject to copyright contrary to the provisions of the Copyright Act 1968 (Cth) you will be taken to have indemnified Wingecarribee Shire Council against any claim or action in respect to breach of copyright. Please note that by lodging a Development Application, applicants acknowledge and agree to the use of all relevant plans and reports lodged with the application for public exhibition purposes and note that they will be made available to the public on Council’s DA Tracker.
